Terms of Sale Agreement

Icons Package (mip001-nc010509)
The digital media files contained within this package (commonly known as the 'massive icons collection' with the internal item number of 'mip001-nc010509') together and collectively comprise the whole of the item and may be referred to as the 'item,' 'collection,' 'package' or with the use of other terminology throughout this document.  Excepting where specified it is understood that, when reference to this item is made anywhere in this document it is the whole of the item that is being referenced regardless of the terminology used to describe the item including but not limited to the terms listed above.

Agreement of Terms and Conditions
This document is a legal agreement between you, the purchaser of the prospective icons package and Nifter.com, the seller of this item.  Purchase of the icons package signifies that you have read, understand and agree to all of the terms and conditions contained within this document known as the Terms of Sale agreement.  If there is any portion of this terms of sale agreement that you do not agree with, question or do not understand then you should not purchase this item until such time that the contents of this entire document are satisfactory to you.  You are welcome to address questions or concerns to support@nifter.com at any time before the sale.  As noted above and repeated here, the purchase of this item is verification that you have read, understand and agree to the contents of this document.  The agreement between parties this document verifies cannot be recinded without a signed agreement in writing by both parties that verifies this action.  Failure to read, understand and/or agree to any and all terms and/or conditions contained herein is not grounds for withdrawal from this contract at any time for any reason whatsoever.

Contents of the Package
The number of files contained within the package as stated on the Nifter.com website is an approximation
 of the total number and is not intended to and does not represent the actual number of files within the package.  No accurate accounting of the exact number or types of files contained in this package has been or will be made.  You understand this fact and agree to accept the number and types of files as delivered as the full, complete and total package.  No additional files other than those delivered at the time of purchase should be expected nor can they be demanded for any reason whatsoever.  You agree to accept the package 'as is' with no expectations of additional files, products or services of any kind at any time whether now or in the future.  Further, you understand and agree that category file counts as stated on the Nifter.com website are also approximate and may not represent the actual number or types of files received in any particular category with the same conditions and 'as is' status as the package as a whole carries.  (Category file counts are those outlined in the icons package description as shown on the following web page at nifter.com: 'http://www.nifter.com/computer_icons_collections.htm'  Nifter.com nor any of its agents or distributors do not guarantee the quality of the files in this package nor can we or our agents or distributors guarantee that non-functional files (commonly called corrupt files) do not exist within the package.  You are purchasing this package individually and collectively 'as is' and as a final sale with no further expectations implied or offered.

Use of the Files, Copyright and Condition
You understand fully that any and all monies or other credits of any kind paid and/or given to the seller of this item (Nifter.com) are for the convenience of packaging the icons and other files in the collection into its current state as a single zip (compressed) file and providing a download location for the package and are not paid and/or given for any other reason whatsoever including but not limited to transferring ownership of the icons.  If a file or files is currently owned by another party that party retains ownership and you are bound by any laws or other legal ramifications that may exist for the benefit of the party that owns the file or files and/or copyright to any file or files.

You understand that Nifter.com may not hold the copyright to each and every file in this collection and as such you agree to verify the copyright owner of any specific file or files before using it or them in a commercial venture or for any purpose that requires permission of the copyright owner.  Although all files within the package that were not created by Nifter.com were understood by Nifter.com to be in the public domain at the point of sale you understand and agree that this has not been verified due to the complexity of the task and/or the copyright status of a file or files may change in the future and that if you intend to distribute the files, in whole or in part by any means whatsoever for financial reward, free or otherwise you accept full and complete responsibility and liability for any legal consequence that arises from the distribution of any or all of the files in the package.  Nifter.com cannot be held responsible for any action or actions of any kind that you take regarding the distribution, private or public use of these files.  You understand fully that Nifter.com is not selling or offering for sale any of the files in the aforementioned collection, rather, Nifter.com is providing the convenience of bundling the files of the package into one zip (compressed) file and providing a download location where you can access it.  All files retain their original ownership and as such you understand you are bound and obligated to follow any legal conditions of this fact.  Nifter.com makes no representation as to the actual number or numbers of individual, separate or distinct files in the package and/or that any file is unique to all of the others in the collection.  You understand and agree to accept as a condition of purchase that any specific file may be present an unlimited number of times within the collection, that Nifter.com makes no claim as to the actual number of individual files and that your expectation of the total number of files to be received includes duplicates of any or all files in an unlimited amount.  You accept the fact that estimated counts include files that may be present more than once as duplicates of a particular file and that any and all duplicates are counted towards the total number of files in the collection / package.  Further, there is no guarantee that any of the files in the collection will function on any given computer operating system.  It is up to you to verify that any or all files will function correctly with the equipment you plan to use them on before purchasing the package. The 'Massive Icons Collection' package description web page (as noted above) clearly states that the files in this package are intended for Microsoft Windows operating systems and the file types (by file extension) are also noted on this page.  You understand and agree that no refund, exchange, credit or other gain is offered for any reason whatsoever including the purchase of this package when you have not verified that the files will function on your equipment.

Refunds, Exchange or Credit
Due to the fact that digital media can be easily transferred to any computer storage device making it impossible for Nifter.com to distinguish between honest and dishonest requests, we regret that no refund, exchange or credit of any kind is offered for this purchase regardless of reason or circumstance.  You fully understand this policy and agree that no refund, exchange or credit of any kind is offered with this sale and that the purchase of this item completes the transaction with no further support, offer or other expectation implied or given.  You understand fully and agree that the purchase of the icons package, item# mip001-nc010509 is a final sale transaction sold on an 'as is' basis with no warranty, guarantee or support implied or offered and that a refund, exchange or any other credit, benefit or gain is not offered or available and will not be offered or available for any reason whatsoever.
